INTRODUCTION TO PERSONAL INSOLVENCY

Who the course is for: This advanced one day course is for advisers who have at least Basic Debt Counselling knowledge and are already dealing with multiple debt cases. It offers the opportunity to look in detail at bankruptcy, its effects and alternatives.

Aims:

  • To provide an introduction to personal insolvency
  • To enable advisers to advise on bankruptcy, its effects and alternatives

Course Content:

  • Responding to creditors' petition
  • Advising on and assisting with the presentation of a debtor's petition
  • The effects of bankruptcy
    • restrictions on individuals
    • the bankrupt's property, including the family home
    • bankruptcy offences
    • discharge from bankruptcy and its effects
  • Alternatives to bankruptcy, including IVA's
  • Duties and powers of the trustee and official receiver
